Termination of Decedent's Interest
The HT-110 form, officially titled "Termination of Decedent's Interest," is used to formally transfer property ownership after the death of a joint tenant, life tenant, or when property is held under a Transfer on Death (TOD) designation. This form provides public notice that a person's interest in a property has ended due to their death.
Quit Claim
A legal document used to transfer property ownership where the seller (grantor) relinquishes any interest they may have in the property to the buyer (grantee) without any guarantee of the validity or extent of that interest.
It essentially says, "whatever interest I have, if any, I transfer to you". This differs from a warranty deed, which includes a guarantee that the seller has clear title.
Warranty Deed
A legal document used to transfer ownership of real estate, providing the buyer (grantee) with the strongest protections regarding the property's title.
It includes guarantees from the seller (grantor) that they have the right to sell the property, that the title is free from undisclosed encumbrances, and that they will defend the buyer's ownership against claims from others.
Land Contract
Specifically State Bar of Wisconsin Form 11, is a document used to formalize a real estate transaction where the seller finances the purchase for the buyer.
It outlines the terms of the agreement, including the purchase price, payment schedule, and interest rate. The buyer gains equitable title to the property while the seller retains legal title until the final payment is made.
Transfer of Death to Beneficiary
A Transfer on Death (TOD) deed, also known as a beneficiary deed, allows a property owner to designate a beneficiary who will inherit their real estate upon their death, without going through probate.
This method helps streamline the transfer process and avoids probate court proceedings.
Power of Attorney
A Power of Attorney (POA) form is a legal document that allows one person (the principal) to appoint another person (the agent) to act on their behalf, typically for financial or healthcare decisions.
It's a crucial part of estate planning, particularly for managing affairs when someone is unable to do so themselves.
W9
Titled "Request for Taxpayer Identification Number and Certification", is an official Internal Revenue Service (IRS) tax form, not specific to Wisconsin.
Its purpose is to obtain a person's or entity's correct Taxpayer Identification Number (TIN), which can be an individual's Social Security Number (SSN), an Individual Taxpayer Identification Number (ITIN), or a business's Employer Identification Number (EIN).
